The Toon People Friendly End User License Agreement governs any free content distributed through this site that does not otherwise include its own EULA. Sorry, we have to ask you to agree to something like this, but we need to protect our models.
This is a binding legal agreement between you (YOU) and Proactive International, LLC (PUBLISHER), the owner of the Meshbox Design brand and the Product (including geometry, modification files, textures and other components of the model) licensed under this Agreement. By request (electronic or otherwise) to have access to this Product, you signify that you have read and agree with all terms of this Agreement.
All rights not expressly granted under this license to YOU are expressly reserved by PUBLISHER; any violation of this agreement immediately terminates any rights granted under this Agreement.
You and PUBLISHER agree that this Product, which includes 3D models, contains intellectual property that is copyrighted and owned by PUBLISHER under the laws of the United States and Washington County, Oregon, and that any recourse or action in its regard are found solely through the courts of Washington County and the State of Oregon.
There is no warranty as to the suitability of this Product for any purpose.
Your Rights to Rendered Art
You may use the model in its original format to generate rendered artwork, including still, 2D images and still 2D animation (“rendered art”); any rendered art may not infringe on any intellectual property or conflict with any intellectual property (trademark, copyright or other) of PUBLISHER. You own the intellectual property rights to any rendered artwork you make, subject to the limitations set down in this agreement.
Your rights are personal, non-exclusive and non-transferable in regards to the license to use the Product.
Your Rights to Make Compatible Products
You may create or distribute (for free or commercial purposes) your own add-ons for this Product provided that no portion of this Product is included in its original, exported or otherwise transformed format, in your add-on; for the purposes of creating add-ons, any merchant resource designated for that purpose may be used under its own license.
If there is an official logo program for this Product, you agree that use of the official logo is subject to the terms of the Agreement associated with the official logo program; violation of this Agreement or the logo program agreement automatically terminates your rights under both.
If you do not otherwise breach this Agreement, you may use the term “for Chunk™” to indicate compatibility without prior permission. If you declare any intellectual property rights within your add-on product, you also agree to add “Chunk is a trademark of Meshbox Design, 2011” or similar declaration.
Your Responsibilities under this Agreement
If you received this product for free, you agree to, in good faith, tell two friends or more about it, either by email or by posting to public forums or indicating approval through social networking sites such as Facebook.
Limitations on Your Rights
You may not use this Product for any purpose that involves pornography or obscenity, which includes artwork of any sexual crime or sexual act in words, action or display, or display of genitalia. You may not create add-on products that add genitalia to the models.
You may not use this Product to produce derivative works that otherwise compete with the Product in its original state or in an exported or translated state.
You may not upload, transmit or otherwise make available to any other party the original files of this Product, or allow others to use your network or accessible storage to upload this Product.
Meshbox Design specifically reserves the right to create original Christmas themed models, characters and add-ons for this Product as a part of its Toon Santa themed product line; a separate license is available by contacting Meshbox Design.
You recognize the ownership of intellectual property by PUBLISHER of Chunk™, Toon People ™, Toon Santa ™, Fedoraville ™, Bonehollow ™ and other original character names that may apply to this product, and not to use these marks without the express permission of PUBLISHER, or under the sole exception of use under this Agreement.
Other Legal Issues
PUBLISHER warrants that to the best of its knowledge, no portion of this Product infringes on the rights (patent, copyright, trademark or trade secret) of any other party; you are solely responsible for ensuring any use or work using the Product does not infringe on the rights of any other party, and indemnify and hold PUBLISHER harmless for any use or work of your use of Product.
You agree that any costs and expenses of enforcement by PUBLISHER under this Agreement against you are yours and agree to pay PUBLISHER any fee for enforcement.
